Welcome to TripCar! These Terms and Conditions ("Terms") govern your use of our car rental with driver services, website (https://tripcar.in), and any related services we provide. By accessing or using our services, you agree to be bound by these Terms.
Please read these Terms carefully before using our services. If you do not agree with any part of these Terms, you must not use our services.
1. Definitions
- "TripCar," "we," "us," or "our" refers to TripCar car rental service.
- "Customer," "you," or "your" refers to the person or entity booking our services.
- "Driver" refers to the professional driver assigned to your trip.
- "Vehicle" refers to the car provided for your rental.
- "Services" refers to our car rental with driver services.
2. Service Description
TripCar provides car rental services with experienced drivers for travel to various destinations in Madhya Pradesh and North India, including but not limited to Orchha, Khajuraho, Agra, Jhansi, Shivpuri, Datia, Chanderi, Bateshwar, Morena, and Tikamgarh.
Our services include:
- One-way taxi services
- Round-trip packages
- Full-day sightseeing tours
- Multi-city tour packages
- Customized travel itineraries
3. Booking and Reservations
3.1 Making a Booking
You can book our services through our website, phone (+91-9960281898), WhatsApp, or email (tripcar.in@gmail.com). All bookings are subject to availability and confirmation from TripCar.
3.2 Booking Confirmation
A booking is confirmed only when you receive written confirmation from TripCar via email, WhatsApp, or SMS. The confirmation will include trip details, vehicle type, pricing, pickup time, and driver information (if available).
3.3 Advance Booking
We recommend booking at least 24-48 hours in advance for best availability. Last-minute bookings are subject to vehicle and driver availability.
3.4 Accurate Information
You are responsible for providing accurate information (name, phone number, pickup location, travel dates, number of passengers). TripCar is not liable for issues arising from incorrect information provided by the customer.
4. Pricing and Payment
4.1 Pricing
All prices are quoted in Indian Rupees (INR) and include fuel charges, driver allowance (bata), tolls, parking fees, and applicable taxes, unless otherwise stated. Prices are subject to change without prior notice.
4.2 Payment Methods
We accept payments via cash, UPI, bank transfer, credit/debit cards (online bookings), and other digital payment methods. Payment terms will be communicated at the time of booking.
4.3 Advance Payment
For certain bookings, we may require an advance payment (typically 20-50% of the total fare) to confirm your reservation. The remaining balance is payable at the completion of the trip or as agreed.
4.4 Extra Charges
Additional charges may apply for:
- Route changes or destination additions not included in the original booking
- Waiting time beyond the agreed limit (charges communicated in advance)
- Vehicle damage caused by customer negligence
- Late-night pickups (11 PM - 6 AM) may incur additional charges
5. Cancellation and Refund Policy
5.1 Cancellation by Customer
- More than 24 hours before trip: Full refund of advance payment (if any), minus processing fees.
- 12-24 hours before trip: 50% refund of advance payment.
- Less than 12 hours before trip: No refund.
- No-show: No refund.
5.2 Cancellation by TripCar
In rare cases, we may cancel your booking due to unforeseen circumstances (driver unavailability, vehicle breakdown, natural disasters, etc.). In such cases, we will provide a full refund or offer an alternative vehicle at no extra cost.
5.3 Refund Processing
Approved refunds will be processed within 5-7 business days to the original payment method.
6. Customer Responsibilities
As a customer, you agree to:
- Be ready at the agreed pickup time and location.
- Treat the driver and vehicle with respect and courtesy.
- Not smoke, consume alcohol, or carry illegal substances inside the vehicle.
- Not damage or misuse the vehicle or its equipment.
- Follow traffic laws and driver instructions during the trip.
- Pay the agreed fare on time as per the payment terms.
- Inform TripCar immediately of any issues, accidents, or emergencies during the trip.
- Ensure luggage does not exceed vehicle capacity.
7. Driver and Vehicle
7.1 Driver Assignment
TripCar will assign a professional, experienced, and verified driver for your trip. Driver details (name, phone number) will be shared before the trip starts.
7.2 Vehicle Standards
All vehicles are well-maintained, clean, and equipped with air conditioning. We strive to provide the vehicle type confirmed at booking, but reserve the right to substitute with a similar or better vehicle if needed.
7.3 Driver Authority
The driver has the authority to refuse service or terminate the trip if the customer engages in illegal activities, threatens safety, causes damage, or violates these Terms. No refund will be issued in such cases.
8. Liability and Insurance
8.1 Vehicle Insurance
All our vehicles are insured as per Indian law. However, this insurance does not cover customer belongings or personal injuries beyond what is legally required.
8.2 Personal Belongings
TripCar is not responsible for loss, theft, or damage to your personal belongings during the trip. You are advised to take care of your valuables at all times.
8.3 Limitation of Liability
TripCar's liability is limited to the amount paid for the specific booking. We are not liable for indirect, incidental, or consequential damages arising from the use of our services.
8.4 Customer-Caused Damage
You are liable for any damage to the vehicle caused by your negligence, misuse, or violation of these Terms. Repair costs will be charged to you.
9. Force Majeure
TripCar is not liable for failure to perform services due to circumstances beyond our reasonable control, including but not limited to natural disasters, acts of God, war, terrorism, pandemics, government restrictions, strikes, or road closures. In such cases, we will work with you to reschedule or provide a refund.
10. Intellectual Property
All content on the TripCar website (text, images, logos, graphics, design) is the property of TripCar and protected by copyright and trademark laws. You may not reproduce, distribute, or use our content without written permission.
11. Privacy
Your use of our services is also governed by our Privacy Policy. By using our services, you consent to the collection, use, and disclosure of your information as described in the Privacy Policy.
12. Dispute Resolution
In the event of any dispute arising from these Terms or the use of our services:
- Both parties agree to first attempt to resolve the dispute amicably through good-faith negotiation.
- If unresolved, disputes will be subject to the exclusive jurisdiction of the courts in Gwalior, Madhya Pradesh, India.
- These Terms are governed by the laws of India.
13. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website. Your continued use of our services after changes are posted constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.
14. Severability
If any provision of these Terms is found to be invalid or unenforceable by a court of law, the remaining provisions will continue in full force and effect.
